Texas regulates lawyer advertising through Rules 7.01 through 7.06 of the Texas Disciplinary Rules of Professional Conduct, which were substantially revised in 2021, and those rules apply to law firm websites and online communications. Texas is one of the states with a mandatory filing requirement, which makes compliance more involved here than in California or North Carolina. Rule 7.01, communications concerning a lawyer's services. The core standard prohibits false or misleading communications about a lawyer or the lawyer's services. As with every state, this governs case results, testimonials, and comparative claims on a firm's website, all of which need careful framing so they demonstrate competence without implying a guaranteed outcome.
Rule 7.04, filing requirements for advertisements and solicitation communications. This is the rule that most surprises firms new to Texas. Under Rule 7.04, a lawyer shall file with the Advertising Review Committee of the State Bar of Texas, no later than ten days after the date an advertisement of legal services is first disseminated, a copy of the advertisement in the form in which it appeared, a completed application, and the required fee. In other words, Texas requires firms to file qualifying advertisements with the State Bar, and the default deadline is within ten days after the ad first runs. Texas also offers a pre-approval path: under Rule 7.04, a lawyer who wants to secure pre-approval may submit the advertisement, or a description of a not-yet-produced advertisement, not fewer than thirty days prior to first dissemination, and a finding of compliance is binding in favor of the submitting lawyer as to the materials submitted, provided the lawyer fairly and accurately described what was later produced. That pre-approval option is a genuine risk-reducer for a firm launching new advertising.
Rule 7.05, exemptions from the filing requirement. Not every communication has to be filed. Rule 7.05 sets out categories of information and communications that are exempt from the Rule 7.04 filing requirement. Whether a particular firm website, or specific pages of it, falls inside an exemption is a determination the firm and its counsel need to make against the current rule text. Because the boundaries matter and the rules were revised in 2021, we build to compliance and flag the filing question rather than assuming a site is automatically exempt.
Board certification and specialization claims. In Texas, board certification is granted by the Texas Board of Legal Specialization, and the phrase "Board Certified" refers specifically to a Certificate of Special Competence from that body. A firm that is not board certified must not state or imply that it is, because a false or misleading statement about a lawyer's services violates Texas Rule of Professional Conduct 7.01. Texas overhauled its lawyer advertising rules in 2021, and the requirements for stating or disclaiming board certification live inside that current regime, so any certification language on a firm's site should be written to the current Texas rules rather than to older versions that still circulate online.
