California attorney advertising rules every firm website has to respect

California adopted a comprehensive set of attorney advertising rules that took effect on November 1, 2018, replacing the older Rule 1-400. Rules 7.1 through 7.5 of the California Rules of Professional Conduct govern what a law firm can say in any communication, and the State Bar has confirmed these rules apply to attorney and law firm websites and online marketing, not only to television or print. Below is how the rules that matter most for a website actually read, sourced from the State Bar of California.

Rule 7.1, false or misleading communications. A lawyer shall not make a false or misleading communication about the lawyer or the lawyer's services. Under Rule 7.1, even a truthful statement about results achieved for past clients, or a testimonial or endorsement, can be misleading if it is presented so as to lead a reasonable person to form an unjustified expectation that they could obtain the same result. In practice this means case-result numbers and client testimonials on a California firm's site need careful framing and, where appropriate, qualifying language, so the page demonstrates competence without implying a guarantee.

Rule 7.2, advertising. Subject to Rules 7.1 and 7.3, a lawyer may advertise services through any written, recorded, or electronic means, including online media. Rule 7.2 also restricts giving anything of value to a person for recommending the lawyer's services, with an exception for the reasonable costs of permitted advertising. This shapes how referral arrangements and paid placements can be structured.

Rule 7.3, solicitation of clients. Rule 7.3 governs direct solicitation and places limits on real-time or targeted outreach to specific people known to need legal services in a particular matter. A website that invites contact is advertising, not prohibited solicitation, but the line matters and we build to the right side of it.

Rule 7.4, communication of fields of practice and specialization. This is the rule California firms most often get wrong on their sites. Under Rule 7.4, a lawyer shall not state that the lawyer is a certified specialist in a particular field of law unless the lawyer holds a current certificate as a specialist issued by the State Bar of California Board of Legal Specialization, or another entity accredited by the State Bar to designate specialists, and the communication states the complete name of the entity that granted the certification. A firm can describe what it does. It cannot call itself a "certified specialist" on its website unless it holds that certification and names the certifying body. Rule 7.5, firm names and trade names. Rule 7.5 governs firm names and trade names and prohibits names that are false or misleading. This matters when a firm uses a trade-style brand name for its website or a geographic descriptor.

One practical note that separates California from states like Florida and Texas: California does not require law firms to file their advertisements or websites with the State Bar for pre-review. The obligation is to comply with Rules 7.1 through 7.5, not to submit pages for approval.
